Introduction
Bookings for property by Holidaymakers are accepted by Glampmanager as an agent for the Property Owner. By proceeding with the booking You accept the terms and conditions of this Booking Agreement.
This Booking Agreement is a legally binding contract between the Property Owner and the Holidaymaker. The Property Owner is also referred to as “We” and “Us”. Glampmanager acts only as an agent for the Property Owner and cannot accept responsibility for acts or omissions of the Property Owner and the services provided by them.
The Holidaymaker(s) must be over 18 years at the time of booking.
The Holidaymaker is the person who makes the online payment. This person is responsible for ensuring all members of their party using the property accept and adhere to this Agreement. The Holidaymaker is also referred to as “You” or “Your”.
Bookings
A booking deposit is payable when the provisional booking is taken. The booking is taken on a provisional basis until the deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed it can be cancelled by Us at any time without prior notice.
The balance of the rental charge, along with the breakage deposit if applicable, is payable not less than 14 days prior to the start of the holiday. Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the booking by the Holidaymaker. Automated payment reminders will be issued as standard practice. Please be sure to note the due dates of these payments should reminders not be routinely issued.
Bookings made less than 14 days prior to the arrival date must be paid in full at the time of booking.
If, after You have received Your booking confirmation, You wish to amend Your arrangements, you must do so by contacting the Property Owner direct and note that charges may apply.
Cancellation by the Holidaymaker
Cancellation of the booking by the Holidaymaker should be made via email and sent to hartlakeescapes@outlook.com. In the event of a cancellation, We will attempt to re-let the property and if successful, a discretionary payment may be made to the Holidaymaker
Cancellation by the Property Owner
The Property Owner will endeavour to make sure the stated property is available for the dates contracted. In the unlikely event the property becomes not available and the Property Owner has to cancel the booking, the Property Owner will endeavour to find the Holidaymaker suitable alternative property. If suitable alternative property cannot be found, the Holidaymaker shall be entitled to a full refund. The Property Owner shall only be liable to return the monies received. No compensation or consequential or direct losses shall be paid.
Miscellaneous
Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The Holidaymaker accepts that no refunds are available for such discrepancies.
The Property Owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required.
The Property Owner reserves the right to refuse entry to anyone, who in the Property Owner’s opinion is not suitable to or capable of taking charge of the property.
The Holidaymaker should not cause nuisance or annoyance to occupants of any property nearby.
The Property Owner reserves the right to ask the Holidaymaker and their party to leave the property, without refund, should the behaviour of the Holidaymaker and/or their party be considered by the Property Owner to be unreasonable. The Holidaymaker will remain liable for the whole cost of the booking and no refund shall be due.
Number of Guests
The maximum number of people entitled to stay at this property is 2 and furthermore, only those people named on the booking form are entitled to stay. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the Holidaymaker and their party will be asked to leave immediately without any refund. Sub letting or assignment of the let is prohibited.
Pets
Pets are not allowed in the property unless by prior agreement with the Property Owner.
Arrival and Departure Time
Every effort will be made to have the property available from 15:00 on the day of arrival. Holidaymakers are asked to check-in to the property by no later than 20:00 on the day of arrival.
The property must be vacated by 10:00 on the day of departure. Late departure may result in an additional charge being made, unless by prior agreement with The Property Owner.
Information about keys and how to collect them will be provided once full payment has been received.
Liability whilst staying at the property
The Property Owner takes no responsibility for the personal possessions of the Holidaymaker or the Holidaymaker’s party. Vehicles and possessions are left at the Property Owners property entirely at the risk of the Holidaymaker.
Cleaning
We would like to think the Holidaymaker and party would treat the property as they would their own home and at the end of the holiday the property is left in a clean and tidy condition.. The Property Owner retains the right to make an additional charge for cleaning should the property not be left in a similar condition to the way it was found at the start of the holiday.
Breakages
The Holidaymaker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages should be reported to the Property Owner (or their representative) as soon it occurs/is discovered and no later than the day of departure. The Property Owner retains the right to make an additional charge for unreasonable damage and breakages although it should be noted that minor breakages and general wear and tear (in the opinion of the Property Owner) will not be charged for.
Force Majeure
Neither Glampmanager or the Property Owner can accept responsibility for any costs or other expenses incurred as a result of any alterations, or cancellations due to unusual or unforeseeable circumstances beyond their control. This includes but is not limited to decisions of an appropriate regulatory authority, communicable diseases, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire or adverse weather conditions.
Complaints Procedure
Every endeavour is made to ensure Your stay is memorable for all the right reasons. However, We do recognise that from to time things do go wrong. In these circumstances, it is the responsibility of the Holidaymaker to make any such problem known to the Property Owner (or their representative) immediately it becomes apparent, thereby giving the Property Owner the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.
The Property Owner will make every endeavour to rectify any identified problems as soon as is reasonably possible.
Return of Breakage Deposit
Your breakage deposit, if applicable, will be returned to You within 3 weeks of the departure less any reasonable amounts retained by the Property Owner to cover the costs of repairing damage or loss.
Glampmanagers Liability to the Holidaymaker
As agent for the Property Owner, Glamp Manager responsibilities are limited to making Your booking in accordance with Your instructions, collecting payments and forwarding same to the Property Owner. The contract for Your booking is directly with the Property Owner and in accordance with any additional booking conditions they provide to You. In the event that You suffer any damage or personal injury or death Your claim is against the relevant Property Owner and You have no claim against Glampmanager other than in the event of our negligence. Glampmanager cannot accept any liability for the booking arrangement(s), for any information concerning the booking arrangement(s) which we pass on to You in good faith, for the performance of Your contract with the Property Owner, or for the acts or omissions of the Property Owner or of any employee(s) or agent(s) of the Property Owner, or any other person or party in any way connected with the booking arrangement(s).
However, in the event that we are found liable to You on any basis whatsoever (for any booking arrangement(s), our maximum liability to You is limited to the cost of the booking arrangement(s) in question. Glampmanager do not exclude or limit any liability for death or personal injury which arises as a result of our or that of any of our employees whilst acting in the course of their employment, negligence, fraud or fraudulent misrepresentation (or any other liability which cannot be excluded by law).
